California Healthcare Worker Labor Law
Workers in California's healthcare industry include nurses, physical therapists, lab technicians, radiology technicians, caregivers and other people who provide healthcare assistance. These workers may have their rights to minimum wage and overtime violated.
The rights protecting healthcare workers have been in the news, with home health workers initially receiving protection under federal overtime and minimum wage laws, and then having those rights overturned by a court judge. Despite that, many employees in the healthcare industry are eligible for wage and hour protections, as well as certain meal period or rest breaks as required by law.
Some California healthcare workers may be incorrectly classified as exempt from overtime pay or as independent contractors to get around wage and hour laws. Workers whose rights have been violated may be able to file a lawsuit to protect their rights and recover missing wages.
